Trade work that belongs with a solicitor, not a consultancy slogan

Corporations call this work international trade advisory. In practice it is a set of Australian legal problems: whether a counterparty is designated for sanctions, whether software or a device needs a Defence export permit, whether an acquisition must be notified to the Treasurer, and how those risks sit in the contract. Hamilton Bailey advises the company. We do not sell political-risk reports, kidnap response, or reputation campaigns.

Sanctions compliance

Advice on Australia's United Nations and autonomous sanctions, screening counterparties against the Consolidated List, and applications to the Australian Sanctions Office. The Office does not give legal advice. We do.

Export controls and dual-use goods

Defence Export Controls permits, Defence and Strategic Goods List classification, and the AUKUS licence-free environment for transfers among Australia, the United Kingdom and the United States.

Foreign investment screening

FIRB notifications, national-security issues, conditions, and post-approval compliance for inbound investment into Australian companies, land, data and infrastructure.

Cross-border contracts

Supply, distribution, licensing and joint-venture terms that allocate sanctions, export-control, customs and change-of-control risk between corporate parties.

Trade remedies and customs

Intake and coordination on anti-dumping, countervailing and customs questions, including Anti-Dumping Commission processes and on-site verification.

What we do not do

Clear limits protect clients as much as the firm. If the matter needs another kind of adviser, we say so and coordinate.

  • Public international law advice to the Commonwealth, including WTO disputes for Australia.
  • Lobbying of Parliament as a regular service, unless the firm is registered to do so.
  • Kidnap, extortion, close protection or intelligence operations.
  • Media buying, crisis public relations, or reputation management as a product.
  • Covert asset tracing or private-inquiry work except through licensed investigators we instruct.

How an engagement runs

    Confirm the transaction, the jurisdictions, and whether the work is Australian legal advice.

    Costs agreement, conflicts check, and a defined scope before substantive work begins.

    Advice and filings

    Sanctions, export-control or FIRB work as required, with specialist counsel where the file leaves Australian law.

Questions

Do you advise Australian Government departments on international trade?

This practice advises corporations. Commonwealth departments generally buy legal services through the Whole of Australian Government Legal Services Panel or the Australian Government Solicitor. Public international law work for the Commonwealth is largely reserved to government lawyers.

Is this a crisis-management or investigations firm?

No. Hamilton Bailey is a law firm. We provide legal advice and, where needed, instruct specialist security, forensic or communications firms. We do not conduct kidnap response, close protection, covert surveillance or media campaigns.
